1. Acceptance of Terms and Definitions

These General Terms and Conditions (hereinafter: "TOS") govern the use of the Discord bot services and the associated website provided by R&V Creations (hereinafter: "Service Provider").

1.1. Acceptance of the TOS

By using any element of the Service (including, but not limited to, inviting the bot to a Discord server, logging in via the website, or purchasing a subscription or other paid services), you acknowledge that you have read, understood, and agree to be legally bound by the provisions of this TOS.

Use of the Service constitutes acceptance by conduct, thereby creating a binding agreement between you and the Service Provider. If you do not agree to these terms, you are not authorized to use the Service.

1.2. Key Definitions

To ensure clarity, the following terms are defined as follows:

  • Service Provider: Refers to the R&V Creations team and its technical infrastructure.
  • User: Any natural or legal person who utilizes the Service.
  • Customer: A User who possesses a paid subscription or has made a one-time purchase through the Service Provider's website.
  • Service: The Discord applications (bots) developed by the Service Provider, their functions and modules, the website, and all associated technical backend systems (e.g., databases).
  • Platform (Discord): The service operated by Discord Inc. Discord is an independent third party; the Service Provider is not responsible for any system-level changes or policies implemented by the Platform.
  • Guild (Server): The specific Discord environment where the bot's functions operate.

1.3. Governing Policies and Compliance

While using the Service, the User is strictly required to comply with Discord's current Terms of Service (ToS) and all associated developer guidelines.

In the event that a User's activity violates Discord's policies, the Service Provider reserves the right to immediately restrict or suspend the Service without prior notice and without providing a refund.

1.4. Effective Date and Modifications

This TOS is effective as of the "Last Updated" date indicated on the website.

The Service Provider reserves the right to unilaterally modify this TOS at any time (particularly in the case of new feature launches or changes in legal regulations). Modifications become effective immediately upon being posted on the website.

2. Service Description

The Service Provider delivers automated services operating on the Discord platform in the form of software-as-a-service (Software as a Service – SaaS). The Service is available in multiple functional tiers, each subject to different rights and conditions.

2.1. Free Bot (Free Global Service)

The Service Provider operates a shared Discord application ("Free Bot") that is available to all Users.

Nature of the Service: The Free Bot is provided on an "as-is" basis, without any guarantee of availability, support, or functionality.

Availability: The Service Provider does not guarantee uninterrupted or continuous operation of the Service.

Modification of Features: The Service Provider reserves the right to modify, restrict, or discontinue any Free Bot functionality at any time, without prior notice.


2.2. Modular Features (Subscription-Based Service)

The Service Provider offers optional, subscription-based features ("Modules") that extend the functionality of the global Discord application.

Nature of Modules: Modules expand the capabilities of the Free Bot (for example: XP systems, advanced moderation tools).

Activation and Availability: A Module is available exclusively for the duration in which the corresponding subscription remains active in the Service Provider's system. The Service Provider does not guarantee immediate activation.

Guild-Specific Scope: Each Module subscription is bound to a specific Discord Guild identifier. Transfer of a subscription to another server is not automatic and may only be permitted at the Service Provider's sole discretion.

Dependencies and Data Accuracy: The operation of Modules depends on the technical functionality of the Discord platform as well as the Service Provider's current development and operational decisions. The User is responsible for providing accurate data required for Module activation, including, but not limited to, the correct Discord Guild identifier (Guild ID). The Service Provider shall not be liable for improper or unintended activation resulting from incorrect or inaccurate data provided by the User.


2.3. White-Label and Custom Bot Solutions (Unavailable Service)

The Service Provider may, at its discretion, develop and introduce white-label or custom bot solutions in the future.

Current Status: Such services are currently unavailable and do not form part of the Service.

Reservation of Rights: The Service Provider reserves the right to:

  • not introduce such services,
  • postpone their introduction indefinitely, or
  • materially modify their technical or operational conditions prior to any release.

No Obligation or Guarantee: Any reference to white-label or custom bot solutions does not constitute an offer, commitment, or guarantee regarding future availability.


2.4. Technical Operation and Development Status

Technical Infrastructure: The Service Provider utilizes various technical systems and infrastructure to operate the Service.

Security: The Service Provider applies reasonable technical and organizational measures to protect the Service; however, error-free operation is not guaranteed.

Development Status: The Service is under continuous development. The User acknowledges that temporary technical issues, feature changes, or service interruptions may occur from time to time.

Maintenance: The Service Provider reserves the right to temporarily suspend the Service for maintenance or security-related reasons. Where maintenance is planned, the Service Provider will make reasonable efforts to notify Users in advance via the Discord platform.

3. Subscription and Pricing

Certain services and features provided by the Service Provider are subject to subscription fees or other paid charges. The terms governing subscription-based services are set forth in this section.

3.1. Pricing and Billing

The fees for paid services are displayed on the Service Provider's website or related interfaces. Fees may apply on a recurring (subscription-based) or one-time basis, depending on the service or module.

Displayed prices include all taxes required by applicable law, unless explicitly stated otherwise on the relevant interface.

The Service Provider reserves the right to modify pricing. Price changes apply immediately to new subscriptions and, for existing subscriptions, from the next billing cycle.


3.2. Subscription Term and Renewal

Subscriptions are entered into for a fixed term and, unless otherwise stated, may renew automatically.

By purchasing a subscription, the User agrees to the renewal method and billing frequency presented at the time of purchase. The Service Provider shall not be liable for any service limitations resulting from failed, delayed, or unsuccessful renewal attempts.

If a subscription is not successfully renewed, the Service Provider is entitled to automatically restrict or deactivate access to the related services or modules.


3.3. Subscription Status and Service Access

A subscription may have one of the following statuses, including but not limited to:

  • active,
  • expired,
  • suspended,
  • terminated.

Access to services or modules depends on the current subscription status. If a subscription is not active, the Service Provider may partially or fully disable the associated functionality.


3.4. Modification and Termination of Subscriptions

The User may modify or terminate a subscription using the interfaces provided, subject to the applicable conditions.

The effects of any modification (including upgrades or downgrades) may be aligned with the applicable billing cycle. The Service Provider is not obligated to apply subscription changes with immediate effect.


3.5. Refunds and Right of Withdrawal

Unless otherwise required by applicable law, all subscription fees and one-time payments are non-refundable.

The User expressly acknowledges that, in the case of digital content or digital services—particularly upon activation of a Module—the right of withdrawal under applicable European Union consumer protection laws is forfeited.

The Service Provider may, at its sole discretion, grant refunds or credits on a case-by-case basis; such actions do not constitute a general obligation.

No refund shall be granted if the Service is restricted or terminated due to a violation of these Terms.


3.6. Third-Party Payment Services

Payments may be processed through third-party payment service providers. The Service Provider shall not be responsible for any issues, limitations, or failures arising from the operation of such third-party payment services.

4. Acceptable Use Policy

The Service may only be used for lawful and intended purposes. This section sets forth the mandatory rules of conduct governing the use of the Service.

4.1. General Obligations

The User is required to:

  • use the Service in compliance with applicable laws and Discord's then-current Terms of Service and related policies,
  • ensure that the use of the bot complies with the rules of the applicable Discord server (Guild),
  • refrain from any conduct that may endanger the operation, security, or reputation of the Service.

4.2. Prohibited Activities

In particular, the following activities are prohibited when using the Service:

  • sending unsolicited or bulk messages (spam),
  • harassing, intimidating, or misleading Discord users or third parties,
  • using the Service to distribute unlawful, harmful, or deceptive content,
  • using the bot or the Service to circumvent Discord's technical or moderation restrictions,
  • abusive, automated, or excessive use of the Service,
  • reverse engineering, tampering with, or unauthorized modification of the Service or any part thereof.

4.3. Security and System Integrity

The User is not permitted to:

  • bypass or weaken any security mechanisms of the Service,
  • overload, disrupt, or interfere with the operation of the Service,
  • attempt unauthorized access to the Service Provider's systems.

Any such activity may result in the immediate restriction or termination of the Service.


4.4. Abuse of Modules

Modules may only be used for their intended purposes.

In particular, it is prohibited to:

  • artificially amplify or distort the functionality of Modules,
  • use Modules to manipulate Discord communities in an artificial or deceptive manner,
  • share, resell, or otherwise make Modules available to third parties without authorization.

4.5. Third Parties and Content

The Service Provider does not monitor and assumes no responsibility for content created, managed, or distributed by Users.

The User bears full responsibility for:

  • content generated or transmitted by the bot,
  • the consequences of actions performed by Modules,
  • moderation decisions made within Discord servers.

4.6. Enforcement Measures and Legal Cooperation

In the event of a violation of this section, the Service Provider is entitled, at its sole discretion and without prior notice, to:

  • temporarily suspend the Service or specific Modules,
  • permanently terminate the Service,
  • deactivate access associated with the subscription.

Violations of the Acceptable Use Policy do not entitle the User to any refund or compensation.

The Service Provider is entitled to notify the competent authorities of activities that violate applicable laws or give rise to a reasonable suspicion thereof, and to cooperate with such authorities in connection with any related investigations.

5. Availability and Changes

The Service is provided as a software-as-a-service (SaaS) solution and its operation depends on technical and external factors. This section governs availability, changes to the Service, and the right to discontinue the Service.

5.1. "As-Is" Service

The Service is provided on an "as-is" basis. The Service Provider does not guarantee that the Service will operate without errors, interruptions, or in accordance with any specific User expectations.

The Service Provider does not provide any service level agreement (SLA) or guaranteed uptime unless expressly agreed in writing.


5.2. Maintenance and Downtime

The Service Provider is entitled to temporarily suspend the Service for maintenance, development, or security reasons.

In the case of planned maintenance, the Service Provider will make reasonable efforts to notify Users in advance via the Discord platform or the website. In the case of urgent or emergency maintenance, prior notice may not be possible.


5.3. Changes to Features and Services

The Service Provider reserves the right to modify, develop, reorganize, or discontinue any features, modules, or aspects of the Service at any time.

Such changes may affect, in particular:

  • the operation or availability of certain features,
  • the content or technical implementation of Modules,
  • the user interface or workflow of the Service.

The Service Provider does not guarantee that any specific feature or Module will remain available in an unchanged form.


5.4. Discontinuation of the Service

The Service Provider reserves the right to discontinue the Service or any part thereof, including Modules, in whole or in part.

Discontinuation may occur for reasons including, but not limited to:

  • business or technical considerations,
  • legal or regulatory requirements,
  • maintaining the sustainability of the Service.

Discontinuation of the Service does not entitle the User to any compensation or claims, unless otherwise required by applicable law.


5.5. Impact of Third-Party Services

The operation of the Service depends in part on the Discord platform and other third-party services. The Service Provider shall not be liable for any service disruptions or limitations resulting from outages, changes, or termination of such third-party services.

6. Suspension and Termination

The Service Provider reserves the right to temporarily suspend or permanently terminate the Service, or any part thereof, in accordance with the provisions of this section.

6.1. Suspension in Case of Violation or Abuse

The Service Provider is entitled to immediately suspend the Service or specific Modules if:

  • the User violates any provision of these Terms,
  • the use of the Service violates Discord's then-current Terms of Service or policies,
  • the use of the Service violates applicable laws or gives rise to a reasonable suspicion thereof,
  • the User's activity endangers the security, stability, or reputation of the Service.

Suspension may occur without prior notice.


6.2. Deactivation of Modules Based on Subscription Status

The Service Provider is entitled to deactivate subscription-based Modules if:

  • the subscription expires,
  • the subscription is suspended or terminated,
  • renewal fails or is delayed.

Deactivation of Modules does not constitute a breach of contract and does not entitle the User to any refund or compensation.


6.3. Termination by the User

The User may terminate use of the Service at any time by canceling the subscription or removing the bot from the relevant Discord server.

Termination does not affect any payment obligations incurred prior to termination.


6.4. Termination by the Service Provider

The Service Provider reserves the right to permanently terminate the Service or any part thereof, including specific Modules, in particular in the following cases:

  • compliance with legal or regulatory obligations,
  • business or technical reasons,
  • to ensure the sustainability of the Service.

Where reasonably possible, the Service Provider will make efforts to notify Users in advance of termination; however, no obligation to do so is assumed.


6.5. Consequences and Legal Effects

In the event of suspension or termination of the Service:

  • the User loses access to the Service and any associated Modules,
  • the Service Provider is not obligated to retain any data or configurations,
  • suspension or termination does not entitle the User to any refund or compensation, unless otherwise required by applicable law.

The provisions of this section do not limit the Service Provider's right to initiate legal or regulatory proceedings where appropriate.

7. Limitation of Liability

This section defines the scope and limitations of the Service Provider's liability in connection with the use of the Service.

7.1. General Limitation of Liability

Use of the Service is at the User's own risk. The Service Provider provides the Service on an "as-is" basis and, to the maximum extent permitted by applicable law, disclaims all liability for any damages arising out of or in connection with the use or inability to use the Service.


7.2. Exclusion of Indirect and Consequential Damages

The Service Provider shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:

  • loss of profits,
  • loss of data,
  • loss of business opportunities,
  • damage to servers, communities, or reputation,
  • consequences of moderation or administrative decisions.

7.3. Discord Platform and Third-Party Actions

The Service Provider shall not be responsible for any damages resulting from the operation, modification, or enforcement actions of the Discord platform, including but not limited to:

  • removal of the bot,
  • changes to permissions,
  • restriction or deletion of servers (Guilds),
  • suspension or termination of user or developer accounts.

The Service Provider shall also not be liable for damages arising from the operation or failure of third-party service providers, including infrastructure, payment, or API providers.


7.4. User Content and User Activity

The Service Provider does not assume responsibility for content created, managed, or distributed by Users.

The User bears sole responsibility for:

  • content generated or transmitted by the bot,
  • actions performed by Modules,
  • moderation decisions made within Discord servers.

7.5. Liability Cap

Where the Service Provider's liability cannot be excluded under applicable law, the total aggregate liability of the Service Provider shall not exceed the total amount of fees actually paid by the User in the twelve (12) months preceding the event giving rise to the liability.


7.6. Statutory Exceptions

Nothing in this section shall limit or exclude liability in cases where such limitation or exclusion is not permitted by applicable law, including cases of willful misconduct or gross negligence.

8. Contact and Complaints Handling

This section governs communication with the Service Provider, as well as the handling of complaints and inquiries related to the Service.

8.1. Contact

The User may contact the Service Provider through the following channels:

  • via the contact details published on the Service Provider's official website,
  • through the official Discord server operated by the Service Provider,
  • electronically, via the email address provided by the Service Provider.

The Service Provider will make reasonable efforts to respond to inquiries and support requests within a reasonable timeframe, but does not guarantee any specific response or resolution time.


8.2. Complaints Handling

The User is entitled to submit complaints regarding the Service in written form to the Service Provider.

When submitting a complaint, it is recommended to include:

  • a clear description of the subject of the complaint,
  • identification of the affected Service, Module, or subscription,
  • a detailed description of the issue.

The Service Provider will review the complaint and make reasonable efforts to respond or resolve it within a reasonable timeframe.


8.3. Legal Remedies

If a complaint cannot be resolved between the User and the Service Provider, the User may pursue their rights in accordance with applicable laws.

The Service Provider strives to resolve disputes amicably and out of court whenever possible.


8.4. Acceptance of Electronic Communication

The User agrees that communication and notices from the Service Provider are primarily conducted electronically.

Communications, notifications, and responses sent electronically shall be deemed to be in written form.

9. Change Log

The Service Provider reserves the right to modify these Terms and Conditions in response to changes in applicable laws, the operation of the Service, or the introduction of new features or services.

9.1. Effective Date and "Last Updated"

The currently effective version of these Terms is indicated by the "Last updated" date displayed at the beginning of this document. Unless otherwise stated by the Service Provider, modifications become effective on the date of publication.

Continued use of the Service after a modification constitutes acceptance of the updated Terms.


9.2. Record of Changes (Change Log)

The Service Provider may document significant changes in the form of a change log for informational purposes. The change log is provided for transparency only; the absence or inaccuracy of a change log entry does not affect the validity or enforceability of the modified Terms.

Example format:

  • YYYY-MM-DD – Initial unified public release of the Terms
  • YYYY-MM-DD – Clarification of service structure
  • YYYY-MM-DD – Update to subscription terms

9.3. Notification of Changes

The Service Provider will make reasonable efforts to inform Users of material changes to the Terms, in particular through:

  • the website,
  • the official Discord server,
  • or other electronic communication channels.

The Service Provider does not guarantee individual notification for every modification.


9.4. Previous Versions

The Service Provider may archive or remove previous versions of the Terms at its discretion. Archived versions are provided for reference only and do not constitute the currently effective Terms.
